Our Agreement

When you place an order with us, you are making an offer to buy our goods. A contract between you and Cheerful Soles for the purchase of our products will exist once we confirm your order via email, thereby accepting your offer. We will send you an email acknowledging receipt of your order.

The formation of this contract will be deemed complete and your confirmation of it will be deemed received at the time and date of the sending of the email, regardless of whether, for reasons outside of our control, you have not received that email.

Cheerful Soles reserve the right to refuse to accept an order at our discretion.

You undertake that all details you provide to Cheerful Soles for the purpose of ordering or purchasing goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods ordered.

If there are any changes to the details supplied by you (such as delivery address or incorrect post code), it is your responsibility to inform Cheerful Soles as soon as possible.

The contract shall be deemed to have been concluded in the United Kingdom and shall be governed by the laws of England and Wales, and you and Cheerful Soles irrevocably submit to the non-exclusive jurisdiction of the English and Welsh courts.

Ordering

We are happy to accept orders via and online transaction whereby you complete the order as a registered user of our site or guest via a secure server. Alternatively you can ring and place an order with us over the phone by calling 01756 75385

 

Processing Your Order

All orders are subject to stock availability and authorisation of your payment

In most cases, unless otherwise stated clearly on our website, we aim to process and dispatch all orders on the day we receive them (Monday – Saturday). An estimated dispatch time frame is stated clearly at the top of each product overview.

Where an item of stock is no longer available we will contact you to let you know. We will refund the full cost back to the payment method used to complete your order.

Where an item of stock is not available immediately for dispatch or is stated as being available within and estimated time scale, we will contact you with a more accurate time scale for delivery

Prices

All our prices are in UK Pounds Sterling and include VAT. Please note that we reserve the right to change prices at any time.

The price you pay is the price displayed on this website at the time we receive your order apart from the following exception:

While we try and ensure that all prices on our website are accurate, errors may occur and despite our best efforts, a small number of products on our website may be miss-priced at any time. If this should happen we will contact you and should you wish to cancel your order at this time you will receive a full refund. 

Payment

We accept the following methods of payment;

Credit / Debit Card (VISA, Maestro, Delta). As online shoppers ourselves we know how important internet security is to you and we want you to know that we take this very seriously. We use Takepayments to host our Online Checkout via their Level 1 PCI Compliant Gateway Servers. No card details are held by Cheerful Soles and you can rest assured that your personal information is being handled correctly by a trusted secure provider.

Paypal If you prefer to use your paypal account to make your puchase then please select that payment option at checkout.

Payment is taken at the time you place your order

Delivery

We offer a free delivery service for UK addresses. Delivery charge is not included in the advertised sale price.  Please refer to our our delivery policy.

CUSTOMS CLEARANCE You may be required to pay customs duty for your purchase at a rate which is determined by the country you reside in. It is your responsibility to make arrangements for this to be paid before your local customs will release your parcel for onward postage with your local postage service provider. We will not consider an item to be lost where we are able to prove that goods are waiting for your payment to release them from local customs authorities.

Refunds and Exchanges

All refunds and exchanges will be made in accordance with our returns policy. Refunds will be credited to the same method of payment that you chose for your initial purchase. You are responsible to paying postage to return items for refund.

Cancellations

Under the Consumer Contracts Regulations 2014, you have a statutory right to cancel your order within 14 days. This period starts from the time you place your order and ends 14 days after you receive your goods. You must notify us that you wish to cancel your order in writing within this time period. This is called the Cooling Off Period.

You must take reasonable care of your purchase and return them to us in the normal way and at your expense. We will not consider that you have taken reasonable care if shoes have been used to an extent other than what would be acceptable if you were trying them on in a shop.

We will be happy to refund the purchase price and any applicable basic delivery charge to you in full within 30 days of your written notification to cancel. You will also need to obtain proof of postage when sending items back. You are responsible for the cost of returning the goods to us.

We hope that you would not a cause to complain, however from time to time we recognise that this may happen. Please address all complaints in writing via email to [email protected]. We will acknowledge your contact and give you an estimated timescale for addressing the nature of your complaint.

  3. Cheerful Soles does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, specifications and descriptions of listed goods, products and services.

  4. Cheerful Soles will do its best to correct errors and omissions as quickly as practicable after being notified of them.

  5. To the fullest extent permitted by applicable law, we disclaim all liability for our employees’ or sub-contractors’ negligence.

  6. Our total liability to you in respect of any claim by you arising out of or in connection with the provision (or the failure to provide) the Goods shall be limited to the value of the goods supplied.

  7. Every provision of this clause excluding or limiting liability shall be construed separately, applying and surviving even if for any reason any of these provisions is held inapplicable or unenforceable in any circumstances, and shall remain in force notwithstanding the expiry or termination of this Agreement.
